These Terms of Use (“Terms”) govern your access to and use of Skysquare’s website, browser extension, applications, APIs, and related services (collectively, the “Services”).

The Services are operated by Symbolscape Inc., with an address at 440 N Barranca Ave #7676, Covina, CA 91723 (“Skysquare,” “we,” “us,” or “our”).

By installing, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Services

Skysquare is a browser-based contextual reading tool. It surfaces publicly available discussion from third-party platforms, including Bluesky, in connection with webpages, articles, research, and other materials you visit.

Skysquare may retrieve, cache, index, organize, filter, rank, summarize, cluster, and display public posts, public profile information, public engagement data, quoted passages, URLs, and related metadata to provide contextual features.

Skysquare is not a social network, publisher, newsroom, or operator of Bluesky or any other third-party platform. We do not control the availability, accuracy, legality, permanence, or editorial decisions of third-party platforms or their users.

2. Eligibility and Authority

You may use the Services only if:

  • You are at least 18 years old or have the consent of a parent or legal guardian who accepts these Terms on your behalf;
  • You can form a legally binding agreement;
  • You comply with these Terms and applicable law; and
  • If you use the Services for an organization, you have authority to bind that organization to these Terms.

Certain features require a valid Bluesky account or another supported third-party account. Your use of those accounts remains subject to the applicable platform’s own terms, policies, and rules.

3. Your Account and Bluesky Sign-In

Skysquare may allow you to connect a Bluesky account through OAuth or another approved authentication method.

You are responsible for maintaining the security of your browser, device, account, and any connected third-party account. Do not share access credentials or allow another person to use your account in a manner that violates these Terms.

Skysquare does not ask for your Bluesky password. When you choose to connect a Bluesky account, authentication is handled through the applicable third-party authorization flow.

You may disconnect a connected account, uninstall the browser extension, or stop using the Services at any time.

4. Browser Extension Permissions and Privacy

By installing or using the Skysquare browser extension, you authorize the extension to access webpage content, URLs, browser context, and other information necessary to provide the features you activate, subject to the permissions disclosed during installation and our Privacy Notice.

Our collection, use, retention, and disclosure of personal information are governed by the Skysquare Privacy Notice, which is incorporated into these Terms.

5. License to Use the Services

Subject to these Terms, Skysquare grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for their intended purposes.

This license does not give you ownership of the Services, the Skysquare software, Skysquare branding, or any proprietary materials made available through the Services.

We may suspend, limit, or revoke this license if you violate these Terms, create security or legal risk, interfere with the Services, or use the Services in a manner that could harm Skysquare, other users, third-party platforms, or the public.

6. Acceptable Use

You agree to use the Services lawfully and responsibly.

You may not:

  • Violate applicable law, regulation, court order, or third-party platform rule;
  • Use the Services to harass, threaten, impersonate, defame, stalk, exploit, or deceive another person;
  • Attempt to gain unauthorized access to Skysquare systems, user accounts, data, infrastructure, or connected third-party services;
  • Circumvent, disable, interfere with, or defeat security features, rate limits, access controls, or technical protections;
  • Reverse engineer, decompile, disassemble, modify, or create derivative works of the Services except to the extent that applicable law expressly permits such activity;
  • Use automated means to extract, scrape, copy, reproduce, archive, or bulk-export material from Skysquare systems except through functionality expressly made available by Skysquare;
  • Interfere with the operation, availability, performance, or security of the Services;
  • Use the Services to build, train, support, or operate a competing product or service using Skysquare’s proprietary materials or non-public data;
  • Misrepresent your affiliation with Skysquare, Bluesky, a publisher, an author, or another person or organization; or
  • Use the Services in a way that infringes or misappropriates another person’s rights.

7. Third-Party Platforms and Public Content

The Services may display material originating from third parties, including public Bluesky posts, profile information, engagement metrics, linked webpages, quoted passages, publisher materials, and other public content (“Third-Party Content”).

Third-Party Content remains subject to the rights, licenses, terms, policies, and responsibilities applicable to its original source and author.

Skysquare does not claim ownership of Third-Party Content merely because it is displayed, indexed, cached, analyzed, or contextualized through the Services.

We may display Third-Party Content in transformed, excerpted, organized, or contextual form, including through text matching, passage highlighting, clustering, ranking, sorting, filtering, previews, or related analytics.

Third-Party Content may be incomplete, outdated, deleted, altered, mislabeled, unavailable, inaccurate, offensive, or otherwise unsuitable. Skysquare does not guarantee that any Third-Party Content is accurate, complete, current, lawful, available, or appropriate.

8. No Editorial Endorsement

Skysquare may use product logic, user-selected settings, engagement signals, account characteristics, recency, relevance, public metadata, and other factors to organize or present content.

The appearance, ranking, display, absence, or prominence of content in the Services does not mean that Skysquare endorses, verifies, adopts, promotes, suppresses, or agrees with that content, its author, or any underlying viewpoint.

Skysquare may remove, limit, obscure, de-rank, or decline to display content when we reasonably believe doing so is necessary for security, legal compliance, technical integrity, rights protection, or operation of the Services.

9. Your Posts, Replies, and Other Activity

Where the Services allow you to compose, reply to, like, repost, follow, save, or otherwise interact with content through a connected third-party account, you are solely responsible for that activity.

You represent that you have the rights and authority necessary to submit or authorize the relevant action.

Content you publish through Bluesky or another third-party platform is governed by that platform’s rules and may be publicly visible according to that platform’s settings and policies.

Skysquare may transmit instructions or content to a connected third-party platform at your direction, but Skysquare does not control whether that platform accepts, displays, distributes, removes, moderates, or preserves the resulting content.

10. Feedback

If you provide comments, suggestions, ideas, bug reports, feature requests, or other feedback about Skysquare, you grant Skysquare a worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify, adapt, publish, and otherwise exploit that feedback for any lawful purpose without compensation or attribution to you.

11. Beta Features and Product Changes

The Services may include beta, preview, experimental, early-release, or incomplete features.

Beta features may change, fail, disappear, produce unexpected results, or be discontinued without notice. You use beta features at your own discretion.

Skysquare may add, remove, modify, suspend, or discontinue any part of the Services at any time, including features, supported domains, integrations, data sources, pricing, access levels, and eligibility requirements.

We are not liable for the modification, suspension, or discontinuation of any feature or portion of the Services.

12. Paid Services, Trials, and Billing

Skysquare may offer paid plans, premium features, trials, subscriptions, one-time purchases, or other paid services (“Paid Services”).

The price, billing frequency, renewal terms, included features, trial conditions, and cancellation method for Paid Services will be disclosed before you complete a purchase.

If you enroll in an automatically renewing subscription, you authorize Skysquare or its payment processor to charge the applicable recurring amount to your chosen payment method until you cancel.

You may cancel a subscription using the cancellation method identified at purchase or in your account settings. Cancellation will generally take effect at the end of the then-current billing period unless otherwise stated at the time of purchase or required by law.

Except where required by law or expressly stated otherwise, payments are nonrefundable and unused access is not converted into refunds or credits.

Skysquare may change the price of Paid Services for a future billing period by providing advance notice as required by law. If you do not agree to the change, you may cancel before the new price takes effect.

13. Intellectual Property

The Services, including Skysquare software, source code, user interfaces, product design, text-matching methods, technical systems, documentation, branding, trademarks, logos, graphics, and original materials, are owned by Skysquare or its licensors and are protected by intellectual-property and other applicable laws.

“Skysquare,” related names, logos, and brand elements are trademarks or service marks of Skysquare or its licensors. You may not use them without prior written permission except as necessary to accurately identify the Services.

Nothing in these Terms transfers any ownership interest in Skysquare’s proprietary materials to you.

If you believe material available through the Services infringes your copyright, trademark, privacy, publicity, or other legal rights, submit a notice to:

Your notice should identify:

  • The material at issue;
  • The relevant URL, post URI, or location in the Services;
  • The rights you believe are implicated;
  • Information sufficient for us to evaluate the request; and
  • Your name and contact information.

Skysquare may investigate, request additional information, remove or restrict access to material, or take any other action we consider appropriate.

15. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYSQUARE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, QUIET ENJOYMENT, AND SECURITY.

WITHOUT LIMITING THE FOREGOING, SKYSQUARE DOES NOT WARRANT THAT:

  • THE SERVICES WILL BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE;
  • THE SERVICES WILL WORK ON EVERY WEBSITE, DEVICE, BROWSER, OR THIRD-PARTY PLATFORM;
  • THIRD-PARTY CONTENT WILL BE ACCURATE, COMPLETE, CURRENT, OR AVAILABLE;
  • CONTENT MATCHING, HIGHLIGHTING, RANKING, FILTERING, OR ANALYTICS WILL BE ERROR-FREE; OR
  • DEFECTS WILL BE CORRECTED.

YOU ARE RESPONSIBLE FOR YOUR USE OF THE SERVICES AND FOR ANY DECISIONS YOU MAKE BASED ON INFORMATION PRESENTED THROUGH THEM.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYSQUARE AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR REPUTATION, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYSQUARE’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID TO SKYSQUARE FOR THE SERVICES DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  2. ONE HUNDRED U.S. DOLLARS ($100).

THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

17. Indemnification

To the maximum extent permitted by law, you will indemnify, defend, and hold harmless Skysquare and its affiliates, licensors, service providers, officers, directors, employees, agents, and representatives from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • Your violation of these Terms;
  • Your violation of applicable law or third-party rights;
  • Your use of a connected third-party account;
  • Content or activity you submit, authorize, publish, or transmit through the Services; or
  • Your misuse of the Services.

This obligation does not apply to the extent a claim results from Skysquare’s own gross negligence, willful misconduct, or violation of law.

18. Dispute Resolution; Individual Arbitration; Class-Action Waiver

Informal Resolution First

Before either party files a claim, the party seeking to bring the claim must first send the other a written notice describing the dispute and the requested resolution.

The parties will attempt in good faith to resolve the dispute informally for at least 30 days after receipt of the notice.

Binding Individual Arbitration

Except for the limited exceptions below, you and Skysquare agree that any dispute, claim, or controversy arising out of or relating to the Services or these Terms will be resolved by binding individual arbitration rather than in court.

This arbitration agreement applies to claims based on contract, tort, statute, regulation, fraud, misrepresentation, negligence, consumer-protection law, privacy law, or any other legal theory.

The arbitration will be administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules and, where applicable, its Mass Arbitration Supplementary Rules, as modified by these Terms.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

Unless the parties agree otherwise, arbitration hearings will be conducted remotely. If an in-person hearing is required, it will take place in Los Angeles County, California, or in the county where you reside, at your election, unless applicable law requires another location.

The arbitrator may award the same individual relief that a court could award under applicable law. The arbitrator may not award relief for or against anyone who is not a party to the individual arbitration.

Skysquare will pay arbitration fees and costs as required by applicable law and the applicable AAA rules.

Exceptions

Either party may bring an individual action in small-claims court if the claim qualifies.

Either party may seek temporary, preliminary, or permanent injunctive relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, unauthorized access, security breach, or misuse of intellectual-property rights, confidential information, systems, or data.

Nothing in these Terms prevents either party from seeking relief that cannot lawfully be waived or required to be arbitrated.

Class-Action and Representative-Action Waiver

YOU AND SKYSQUARE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, PRIVATE ATTORNEY GENERAL, OR PARTICIPANT IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE, OR MASS ACTION, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS, PRESIDE OVER A CLASS OR REPRESENTATIVE PROCEEDING, OR AWARD CLASS-WIDE OR REPRESENTATIVE RELIEF EXCEPT WHERE APPLICABLE LAW REQUIRES OTHERWISE.

Arbitration Opt-Out

You may opt out of this arbitration agreement within 30 days after first accepting these Terms.

To opt out, send a written notice to support+arbitration@symbolscape.com with the subject line “Arbitration Opt-Out.” Your notice must include your name, the email address or account identifier associated with your use of Skysquare, and a clear statement that you wish to opt out of arbitration.

Opting out of arbitration does not affect any other part of these Terms.

19. Governing Law and Judicial Venue

Except to the extent federal law governs arbitration, these Terms and any dispute arising from them are governed by the laws of the State of California, without regard to conflict-of-law principles.

For any dispute that is not subject to arbitration, you and Skysquare agree to the exclusive jurisdiction and venue of the state courts located in Los Angeles County, California, and the federal courts located in the Central District of California.

Nothing in this section limits any non-waivable right or remedy available to you under applicable law.

20. Termination

You may stop using the Services at any time by uninstalling the browser extension, disconnecting connected accounts, canceling any subscription, or otherwise discontinuing use.

Skysquare may suspend or terminate your access to the Services at any time if we reasonably believe that you have violated these Terms, created legal or security risk, harmed another user or third party, or interfered with the Services.

Upon termination, your right to use the Services ends immediately. Sections that by their nature should survive termination will survive, including intellectual-property provisions, disclaimers, limitations of liability, indemnification, dispute resolution, governing law, and general provisions.

21. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will revise the “Last updated” date above. For material changes, we may also provide notice through the Services, on our website, or through another reasonable method.

Changes will apply prospectively from their effective date. Your continued use of the Services after the effective date means that you accept the updated Terms.

Any change to the dispute-resolution provisions will apply only to disputes arising after the updated Terms become effective, unless applicable law permits otherwise.

22. Electronic Communications

By using the Services, you agree that Skysquare may provide notices, disclosures, agreements, and other communications electronically, including through the Services, website, browser extension, or email where available.

You agree that electronic communications satisfy any legal requirement that communications be in writing.

24. General Provisions

These Terms, together with the Privacy Notice and any additional terms presented for a specific feature or purchase, constitute the entire agreement between you and Skysquare concerning the Services.

If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

Skysquare’s failure to enforce any provision is not a waiver of that provision.

You may not assign or transfer these Terms or your rights under them without Skysquare’s prior written consent. Skysquare may assign these Terms in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or similar transaction.

These Terms do not create any agency, partnership, joint venture, employment, fiduciary, or other special relationship between you and Skysquare.
